A practical legal overview of the procedures required to claim, partition, and transfer inherited property in Pakistan.

1. Succession Certificate (NADRA vs Civil Court)

Under the Letters of Administration and Succession Certificates Act 2021, undisputed heirs can obtain certificates via NADRA through biometric verification within 15 days. Where any dispute, overseas heir absence, or minor heir exists, jurisdiction vests exclusively in the Civil Court under the Succession Act 1925.

2. Suit for Declaration (Section 42 Specific Relief Act)

If an heir's entitlement is challenged, fraudulent sale deeds or gift deeds are executed, or revenue authorities refuse mutation (Intiqal), a Suit for Declaration under Section 42 of the Specific Relief Act 1877 establishes lawful title and cancels fraudulent transactions.

3. Suit for Partition (Dividing Joint Inheritance)

Jointly held family property frequently leads to deadlock. Under the Partition Act 1893 and Punjab/Sindh Land Revenue Acts, co-heirs may file for partition through metes and bounds, or court auction with proceeds distributed as per entitled Fara'id quotas.

4. Protection of Women's Rights (Sec. 498-A PPC)

Under Section 498-A of the Pakistan Penal Code, depriving any female of her rightful inheritance by deceit, fraud, or coercion carries severe criminal penalties of up to 10 years imprisonment and fines up to PKR 1,000,000.

5. Overseas Pakistanis Property Protection & Power of Attorney
